Terms of Service
Draft — not yet published
These terms govern access to and use of the FILTER API and dashboard, operated by Parikshram Technologies Private Limited ("FILTER", "we", "us"). By creating an account or using the API, you agree to them.
1. Definitions
- "Service" means the FILTER API, dashboard, free tools, and any related documentation.
- "Customer", "you" means the business entity that has created an account.
- "Credits" means the metered unit consumed per API request, per the logic published in our documentation.
- "API Key" means the authentication credential issued to a Customer to access the Service.
- "Submitted Data" means any phone number or associated data a Customer sends to the Service for validation.
- "Confidential Information" has the meaning given in Section 8.
2. The service
FILTER provides a phone number validation API: it checks whether a submitted number is correctly formatted, currently active, and, where determinable, the operator and line type serving it. Results are provided as-is, based on the best available network signal at the time of the check.
We may modify, suspend, or discontinue any feature of the Service at any time, provided that we will give reasonable notice before any change that materially reduces the Service's core functionality for existing paying Customers.
3. Eligibility and acceptable use
FILTER is a business tool, intended for use by companies validating phone numbers they have lawfully collected — leads, orders, or account signups. It is not intended for consumer-facing use.
You may not use the Service to:
- Validate numbers you do not have a lawful basis to process;
- Harass, stalk, or attempt to physically locate an individual;
- Build or operate a competing phone-validation product using our API;
- Circumvent rate limits, credit metering, or access controls;
- Resell or sublicense API access to a third party without our prior written consent.
We may suspend accounts we reasonably believe are being used for any of the above.
4. Account registration and security
You are responsible for the accuracy of the information provided at signup and for keeping your API Keys confidential. You must notify us promptly at security@usefilter.io if you believe a Key has been compromised — see also the Revoke action described in our API documentation, which takes effect immediately.
You are responsible for all activity that occurs under your account and API Keys, whether or not authorized by you, until you notify us of a compromise.
5. Credits, fees, and payment
Access is metered by Credits, purchased in advance or granted on a plan. One Credit is consumed per lookup per the logic published in our API documentation, regardless of the result returned.
All fees are stated exclusive of applicable taxes (including GST), which are added at checkout where applicable. Fees are payable in Indian Rupees through our payment processor, Razorpay.
Whether Credits expire, and after how long, is not yet decided.
6. Intellectual property
FILTER and its licensors own all right, title, and interest in the Service, including the API, software, and documentation, and all associated trademarks. These Terms grant you a limited, non-exclusive, non-transferable right to access and use the Service for your internal business purposes — nothing here transfers ownership of the Service to you.
As between the parties, you retain all rights to your Submitted Data. You grant FILTER a limited license to process Submitted Data solely to provide the validation result you requested, and for no other purpose.
7. Confidentiality
Each party may receive non-public information from the other ("Confidential Information") in connection with these Terms. Each party agrees to protect the other's Confidential Information with the same degree of care it uses for its own, and not to disclose it except to employees or contractors who need it to perform under these Terms, or as required by law.
Confidential Information does not include information that is or becomes public through no fault of the receiving party, was already known to it, or is independently developed.
8. Data protection
Our collection and processing of personal data, including Submitted Data, is described in full in our Privacy Policy, which forms part of these Terms by reference. You are responsible for having a lawful basis, under the DPDP Act and any other applicable law, for every phone number you submit.
9. Suspension and termination
We may suspend or terminate an account for breach of these Terms, non-payment, or suspected fraudulent or abusive use, with notice where practicable. You may terminate your account at any time by ceasing use and closing your account in the dashboard.
On termination, your right to use the Service ends immediately; unused Credits are handled per our Refund Policy. Sections 6 (Intellectual property), 7 (Confidentiality), 10 (Warranties and disclaimers), 11 (Limitation of liability), 12 (Indemnification), and 14 (Dispute resolution) survive termination.
10. Warranties and disclaimers
The Service is provided "as is" and "as available." We do not warrant that the Service will be uninterrupted or error-free, or that every validation result will be accurate — results reflect the best available signal from third-party telecom networks at the time of the check, which we do not control.
Except as expressly stated in these Terms, we disclaim all other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, to the maximum extent permitted by applicable law.
11. Limitation of liability
We are not liable for business decisions made on the basis of a result — including decisions to contact, ship to, or decline a customer — nor for losses arising from an inaccurate, delayed, or unavailable result.
To the maximum extent permitted by law, neither party's aggregate liability arising out of these Terms will exceed the fees you paid us in the 12 months preceding the claim, and neither party will be liable for indirect, incidental, or consequential damages. This limitation does not apply to breaches of Section 7 (Confidentiality), infringement of intellectual property rights, or a party's indemnification obligations under Section 12.
12. Indemnification
You agree to indemnify and hold FILTER, its officers, and employees harmless from any claim, loss, or liability arising out of: (a) your use of the Service in violation of these Terms or applicable law; (b) Submitted Data you did not have a lawful basis to collect or process; or (c) your violation of any third party's rights, including privacy rights, in connection with your use of the Service.
FILTER agrees to indemnify you against any third-party claim that the Service, as provided by us and used in accordance with these Terms, infringes that third party's intellectual property rights, subject to the limitation of liability in Section 11.
13. Force majeure
Neither party is liable for delay or failure to perform caused by circumstances beyond its reasonable control, including outages of third-party telecom networks, payment processors, or cloud infrastructure providers we rely on, natural disasters, or government action.
14. Governing law and dispute resolution
These Terms are governed by the laws of India, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the Service will first be addressed through good-faith negotiation between the parties. If not resolved within 30 days, the dispute will be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, conducted by a sole arbitrator appointed by mutual agreement, seated in [governing-law city — see note below], in the English language. The courts at [governing-law city — see note below] will have exclusive jurisdiction over any matter not subject to arbitration, including interim relief.
Governing-law city / arbitration seat not yet set.
15. General provisions
- Assignment — you may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Notices — legal notices to FILTER should be sent to the contact details in Section 16; notices to you will be sent to your account's registered email.
- Amendment — we may update these Terms from time to time; material changes will be notified by email or an in-dashboard notice, and continued use after the effective date constitutes acceptance.
- Severability — if any provision is held unenforceable, the remaining provisions continue in full force.
- Entire agreement — these Terms, together with the Privacy Policy and any order form, constitute the entire agreement between the parties on this subject.
